Terms of service
Draft, pending legal review. The substance below describes how the service actually works, but it has not been checked by a lawyer and some details are still to be supplied.
Who we are, and who may use this
This service is operated by [operator legal name to be supplied], of [registered address to be supplied]. You must be eighteen or older to keep an archive here. By registering you agree to these terms.
The account
Keep your password to yourself, and tell us at [contact email to be supplied] if you believe someone else has reached your account. You are responsible for what is done through it.
We may suspend an account that is being used to harass someone, to impersonate a person living or dead, to file death reports in bad faith, or to store material that is unlawful. We will tell you why.
What you write
The archive is yours. You keep every right in it. You give us only the permission needed to run the service — to store your material, to show it back to you, and, after your death has been reported and approved, to publish the specific items you marked for publication, in the way you chose. That permission exists for no other purpose. We do not use what you write to train anything, and we do not sell it.
Please do not upload material you have no right to share, or images of other people who would object to appearing on a memorial. Photographs are limited to ten megabytes each and one hundred per archive.
Death reports and the memorial
A memorial is never published automatically. A trusted contact reports a death; you are told immediately and can dispute it; a second contact or a proof document is required; and then a person on our side reviews the report and decides. Nothing is published on any one person’s say-so.
Filing a death report you know to be false is a serious misuse of this service and grounds for immediate suspension.
After publication the memorial is administered by the person named for that role. They may change its visibility and request its archive. They cannot add to, alter, or remove what the deceased wrote.
What it costs, and refunds
Hosting a published memorial is paid for once. There is no subscription and no recurring charge to the family. Prices are shown before you pay.
If you change your mind, write to [contact email to be supplied] within fourteen days of paying and we will refund you in full. After that a payment is refundable only where the law requires it. If we fail to provide what you paid for, you are entitled to your money back regardless of when you ask.
How long the memorial stays
A memorial that stops when a payment lapses is not a memorial. Once it is paid for we keep it published for as long as we are operating, with no further charge to anyone.
We will not pretend that is the same as forever. If this service is ever wound down we undertake to give at least twelve months’ notice to every memorial administrator we can reach, and to provide a complete downloadable archive of each memorial before it closes, at no cost. We would rather write that down now than have it come as a surprise to someone who trusted us with the only copy.
Closing your account
You may close your account at any time from Settings. We hold the request for 30 days and then remove your account, your archive and your files. Export first if you want a copy; Settings will build you one.
Once a memorial has been published it belongs to the people grieving as much as to the estate, and removing one is handled case by case rather than with a button.
What we promise, and what we cannot
We will take care of what you leave here, and we will not lose it through carelessness. We cannot promise the service is never interrupted, and nothing here limits our liability for death, personal injury, or anything else the law does not permit us to limit. Beyond that, our liability is limited to what you have paid us.
Keep your own copy of anything irreplaceable. The export exists for exactly that reason.
Changes to these terms
If we change these terms in a way that affects you, we will email you at least thirty days beforehand. If you do not accept the change you may close your account and, where you have paid for a memorial that has not yet been published, ask for your money back.
These terms are governed by [governing law to be supplied].
